Conflicto de Competencia.
El proceso le correspondió por reparto al Juzgado Primero Administrativo de Medellín , quien no avocó el conocimiento de la demanda por considerar que la misma se había dirigido al Juzgado Penal del Circuito de esa ciudad, debiéndose respetar la libertad del accionante para escoger la especialidad de l juez de tutela competente para conocer de su acción.
En nuevo reparto le correspondió el proceso al Juzgado Veintiuno Penal del Circuito de Medellín, tampoco avocó el conocimiento del caso por no compartir los argumentos del otro Despacho Judicial por desconocer el contenido de disposición emanada por el Consejo Superior de la Judicatura, en cuanto al reparto de tutelas.
La Sala reitera el contenido y alcance del término competencia a prevención y dirime el conflicto ordenando enviar el expediente al Juzgado Primero Administrativo de Medellín.
